PureDWTS Alfonso Ribeiro Sues Fortnite Creators Over Their Use of the “Carlton Dance” (POLL)

So, this is admittedly a bit DWTS-adjacent, but given that this topic has somewhat been touched on in the past here (and there’s not much to report on DWTS at the moment, outside of tour updates), I figured “Why not see what our readers think?”

For those of you who haven’t heard, news broke this morning that season 19 DWTS champ Alfonso Ribeiro actually filed two separate lawsuits against Epic Games (the creators of Fortnite) and Take Two Interactive (the creators of the NBA 2K series) for their use of his famous “Carlton Dance”:

Carlton wants his dance back.

Actor Alfonso Ribeiro is suing to stop two video game developers from selling a dance popularized by his “Fresh Prince of Bel-Air” character.
In two lawsuits filed Monday, Ribeiro said the companies have “unfairly profited” from using his likeness and from exploiting his “protected creative expression.” The suits name Fortnite developer Epic Games Inc., and Take-Two Interactive Software Inc., creator of the NBA 2K series, and several of its subsidiaries.
Epic Games declined to comment on the lawsuit. Take-Two subsidiary 2K Games did not respond to a request for comment.
The lawsuits ask a California federal court to bar the game developers from using, selling or displaying the dance. The suits state that Ribeiro is in the process of copyrighting the dance.
Ok, so right off the bat, I’ve gotta raise my eyebrows a bit at the fact that Fonz is “in the process of copyrighting the dance”, but doesn’t have it copyrighted YET. I think it might be hard to prove copyright infringement if you don’t even officially own the copyright yet (and the question remains whether you can truly copyright a dance at all – more on that later). I also find the timing a bit curious, as both Fortnite and NBA 2K have been around for over a year (the latter definitely longer, though I don’t know how long they’ve been using the dance), and Fonz is just now slapping them with a suit. But I digress…
…I’ve said more than once that I think copyrighting specific dance moves is a slippery slope – given that dance is an art form that has very much evolved from collaboration and various individual moves slowly becoming widely-known pieces of dance vocabulary, I think granting people the ability to copyright certain moves has a potential chilling effect on dance as a whole. I’m all for people getting credit for their intellectual property, but I think within a dance context that should be applied to entire choreographic works, rather than just specific moves…particularly very simplistic ones, like “The Carlton”, which I think could be argued is a very natural movement that pre-dates Alfonso making it his “thing”. Alfonso has even admitted that he basically came up with the dance just by watching a young Courteney Cox dancing onstage with Bruce Springsteen in the “Dancing in the Dark” video, and imitating Eddie Murphy’s “White People Dance” from his Raw standup performance. All that being said – Alfonso might still have (somewhat of) a leg to stand on.  Check out this post from a trademark lawyer’s website, titled “Can I Trademark a Dance?” – it basically says you can trademark the NAME of a dance, but not necessarily the move itself. So if I’m interpreting it correctly, Alfonso might be able to claim that the move is called “The Carlton” (especially since the Fortnite character that does it supposedly looks a lot like his Fresh Prince character) but I don’t know that he can really claim to have invented the dance and own exclusive rights to it in any capacity. And who the hell knows how you go about monetizing that type of trademark. But here’s where I think it gets even more complicated: I’m not even sure that Alfonso owns the rights to the character of Carlton Banks – it’s hard telling, but I think most of the rights to the characters on Fresh Prince of Bel-Air actually belong to Andy & Susan Borowitz, the show’s creators, and to a lesser degree, Benny Medina (whose life experiences the show was loosely based on).  So does he really have the capacity to say “This is the Carlton dance!” when he himself might not even own the rights to the character that performed it…? I dunno…it all seems pretty murky to me, and it seems like a bit of a cash grab on Alfonso’s part.

PureDWTS Season 28 Cast Rumors & Watchout: James Hinchcliffe Thinks Fellow Indycar Driver Josef Newgarden Should Do DWTS

I’d categorize this one as “there’s a 50/50 chance between this being a complete joke and a legitimate possibility”, given the parties involved 😉

Hinch has said in multiple interviews since his time on DWTS that he’d “love to see Josef Newgarden do DWTS” – I believe he even mentioned it in a Facebook live with Sharna once, and Sharna was onboard with the idea.  Josef’s a fellow Indycar driver (a pretty successful one, too – he won the 2017 Indycar Series Championship), and is considered a sort of Indycar heartthrob – several of the drivers like to joke that he should be a Disney prince or in a boyband. He’s also a goofy guy and doesn’t seem to worry too much about “being cool”, so he’s uninhibited enough to give DWTS a shot, I think.

Well the other day Josef retweeted a gif of himself busting a move on the bricks at IMS (which was actually cropped from a YouTube video of him during the “Harlem Shake” dance craze five years ago), and this is how things went down:

Now while Josef might be kidding (or semi-kidding), I think Hinch is serious – and I think that Josef would actually be a wise casting move on ABC’s part. Charming, attractive, boyish young guy that doesn’t take himself too seriously and isn’t afraid to let loose and give himself over to the experience? That’s practically catnip to DWTS viewers these days (hello, Milo). And given that ABC has time to pin down the next cast (and reeeeallllly needs to focus on getting a quality cast to redeem themselves from the fiasco of season 27), I think they ought to look into Josef – Hinch ended up being wildly popular despite being a relative unknown headed into his season, and Josef is at least semi-well-known.

PureDWTS: Academy Changes Rules for Outstanding Choreography Category – What Does This Mean for DWTS?

Probably not much, in the great scheme of things…but it might *slightly* improve the chances of DWTS getting a nomination:

Restructured Choreography Categories

There will be two separate juried awards:

Outstanding Choreography for Variety and Reality Programming (Variety Series, Variety Special, Structured Reality, Unstructured Reality and Competition Program)
Outstanding Choreography for Scripted Programming (Comedy Series, Drama Series, Limited Series and Television Movie)

There were several other changes made to other categories, such as a minimum length for the Outstanding TV Movie category and a new sound mixing category, per Deadline.  The other rule change which could affect DWTS’ eligibility for nominations involves the “hanging episode” rule, which allows for the submission of certain episodes airing outside the designated eligibility period:

Hanging Episode Eligibility

Eligibility changed from “airing prior to the nomination-round voting deadline” to
“airing prior to the start of nomination-round voting.”

Addendum to Hanging Episode Rule:

Programmed networks may post episodes on a distribution platform in advance of
the episodes’ airdates in cases where they otherwise would be “hanging” or
ineligible because they are scheduled outside the eligibility period. Posting must
meet the following criteria:

● Episodes must be posted within the current eligibility year (i.e., by May 31).
● Episodes may be posted on a private distribution platform accessible only to
Television Academy membership.
● Episodes must be the same in form and content as they will later appear in
their regular time slots.
● The subsequent airing of the episodes must take place within the month of
June.

So what do the above rule changes mean for DWTS? Given that the choreography category has now been split into reality and scripted, it may free up a slot or two for nominations from reality dance shows, since there have been a few rogue nominations from scripted shows (notably Smash, Crazy Ex-Girlfriend, and The Real O’Neals) that have snuck into the category in recent years and given SYTYCD & DWTS a run for their money.  That being said, I’m not sure there was anything particularly noteworthy, choreography-wise, on DWTS this past season (two seasons if you count Juniors) that would be able to stand up to Nigel’s relentless nomination campaigning over at SYTYCD, or some of the genius work coming out of WOD (though they were notably snubbed this past year, likely owing to Nigel’s aforementioned campaigning). As for the scripted category, I have a feeling it’s probably going to be pretty small – maybe only 2-3 nominations – and if there’s a contender for a winner in that category, I think it might be this surprisingly edgy dance from It’s Always Sunny in Philadelphia – can’t remember who tweeted me this (Tres? Robbie?) but it’s a gem:

As for the hanging nomination rule, it won’t affect DWTS this time around, as there’s no spring season that might miss the deadline…but who knows what the future holds.

Report On Old Pros Returning For Possible Last Dancing With The Stars Season, Who Would You Like To See Come Back?

US Magazine has an article up on the Fall Season of Dancing With The Stars. Supposedly, they talked to a “source” who mentions this could be the “last” season of Dancing With The Stars and if it is, they want to make it the greatest by bringing back “old pros”. This is music to my ears. I would love to see Karina Smirnoff, Cheryl Burke, Derek Hough, and Mark Ballas return. I’d also love to see the return of Maks Chmerkovksiy, Peta Murgatroyd, and Edyta Śliwińska. How about you? Be sure to read more at US Magazine.

The ratings have not been what the network had hoped for, despite changing things up with an all-athletes season last spring and Dancing With the Stars: Juniors, which wrapped this month.

The source also added that there are talks of season 28, set to air in the fall, being the last. If that happens, the network is hoping to bring back multiple original pros, including Karina Smirnoff, Cheryl Burke, Derek Hough, Mark Ballas and many more.

“They want to have a great last season if there is just one season left,” the source noted.

Jimmy Kimmel’s Guillermo So Upset About The Dancing with the Stars News

Hi All. I’m back! How are you all? I hope well. I’ve missed you loads. Sorry for my absence, but, life caught up with me in a big way this past year as some of you know, but, I think I’ve found a way to balance everything (hopefully). It will help to balance everything even more with Dancing With The Stars going to only one season for which I’ve been wishing for (for a long time) as too much of something can get overwhelming sometimes, right? PureDWTS Season 28: ABC Release Spring 2019 Schedule – NO SPRING SEASON OF DWTS

ABC just released their spring 2019 schedule, and DWTS isn’t on it – so it looks like we’re going to have to wait until next September for our fix, per Just Jared:

It looks like Dancing With The Stars is taking a break from the spring season on ABC.

The network released it’s full schedule for the upcoming 2019 spring season and the reality competition show was missing.

Instead, the second season of the new American Idol will take over the expected start date on March 3rd @ 8PM.

I’ve been assured the fall season is a definite yes, and the fate of Juniors is still up in the air; I know I’ve said it already, but I’m kinda glad we’re not getting a spring season – I think they need to let the show breathe a bit after the dumpster fire of season 27, and these shotgun shortened seasons just aren’t cutting it. But yeah, what we initially predicted would happen when ABC took on Idol has finally happened: they sacrificed spring season of DWTS at the altar of Katy Perry’s bloated salary. Did any of you actually watch last season…? The only person I know that watched it religiously was the shifty dude I dated for a hot minute back in March/April, and he thought it was “the greatest show on television”.  But he also neglected to inform me that he was still legally married, so I take his opinion with a grain of salt…

PureDWTS DWTS Juniors, Season 1 – THE FINALE: Week 9 Live(ish) Blog!!!

And just like that, the inaugural season of Juniors comes to a close tonight.  Granted, tonight’s episode was already taped wayyyyy back on August 25, but I’ll be honest: I’m surprised that I’ve been able to avoid inadvertently spoiling the winner for over 3 months 😛 According to one outlet, I apparently “strongly insinuated that Kenzie won” (I did?) and someone else on Twitter was claiming that I told him Ariana won (again – I did?), but the only real spoiler I offered about the winner was their gender – you can find that spoiler at the bottom of the master spoiler thread I’ve been linking to all season. Who are your guesses for who wins? I will say this: after the taping of the week 8 show, source told me that they thought that “any of the four remaining couples could win it”. So the outcome of the show was truly surprise for the contestants as well, since they all saw it as anyone’s game.  Except Gleb, apparently, but that’s a story for another time…

Songs & dances here. Bound to be a jam-packed show tonight – each couple is redoing their favorite dance with their pro included this time, and doing a Christmas freestyle. I am so ready to see Brandon doing “Rolex” with Ariana & Artyon 🙂

Say what you will about Alana – but she was always a showman, even if her technique wasn’t great. She delivered in that opener.

Artyon looks like a mini-Keo 😛

Kenzie/Sage/Gleb up first.  Gleb thinks the dance is special “because I’m in it.” May seem innocuous on the surface, but given Gleb’s narcissistic tendencies, it just grates.

I’m thinking Kenzie picking this dance was probably a bit of a strategic career move (since it’s her song), but I don’t know that it’s a particularly memorable dance. The addition of Gleb just made it weirder.

Mandy loves that she got to see that dance a second time. Adam says she’s “a different girl” and “taking no prisoners”. Val thinks she “shined” and then seems to throw a slight dig in at Gleb saying that Kenzie “came in with potential” so she “did great things”. Scores are 9, 9, 10.

Brandon looks exhausted in the package.  I can imagine chasing those two around all season was no easy task 😛

Some nice little flourishes added to the dance with Brandon joining them.  Pretty cute.

Val says “Iconic.” Adam can’t wait to see what they do in the next round. Mandy is complimentary of all three team members and generally fulfills the supportive mom role she has all season.

Tens, tens, TENS ACROSS THE BOARD!

Miles/Rylee/Lindsay redoing the salsa, dalmatian outfits and all. And I gotta hand it to Lindsay – that felt like a cohesive routine, with some nice double-leading by Miles, rather than a retooling with Lindsay just shoehorned in.

Val is glad he redid this dance, since he was so hard on Miles the first time.  Mandy gives Lindsay props for being a great coach.  Adam thinks Miles has “grown so much”. 10, 9, 9 – ok, I thought that was better than Kenzie, but whatevs.

Sky warns Alan that he “better kill it” in this salsa they’re redoing 😛

Alan skateboards in with Sky and bungles it almost immediately, hehe. It’s cute overall, but feels a tad shoehorned. I thought Miles won the “favorite dance” round.

Mandy commends Alan for “diving into” the whole mentor role. Adam thinks Sky has grown the most of the finalists. Val says Sky “emobodies what this competition is about”.

10, 10, 10 – I thought Miles & Rylee were better, but again…whatevs.

Kenzie up first in the freestyle round. Sage says ten more words for a grand total of MAYBE 50 words spoken this season.

It’s pretty hard-hitting hip-hop with a little bit of stepping and Charleston thrown in.  It’s good…maybe my favorite dance she’s done.

Mandy thought it was incredible, and hopes this show has brought back Kenzie’s “love of dance”. Adam just stands  up and shrieks. Val thinks that is what a freestyle should look like.

Worth mentioning: Gleb did enlist the services of an outside choreographer for this freestyle…which I think shows.

10, 10, 10.  I’m guessing freestyle round is probably gonna go the same way it does on the regular show – unless somebody really bungles stuff up, they’re all getting perfect scores.

Ariana & Artyon up next, serving you Grinch & Cindy Lou Who realness 😛

It’s a very theatrical, Broadway-esque dance.  Artyon did two pretty impressive lifts with Ariana.

Adam thinks they had “so much to be proud of”. Val says he thinks they’re going to be “big stars”.  Mandy says Ariana is  “a star”.

9, 10, 9 –  soooo…what was the issue there, Val & Adam?

Miles & Rylee are next.  Loving the snow white costumes 🙂

It’s mainly hip-hop, but I saw blurbs of their jive, Charleston, and even a bit of Carlton Banks 😛 I thought it was excellent. Anthony Anderson in the audience cheering for Miles.

Val thinks Miles has made it “cool” for boys to dance.  Mandy says he’s been such a joy to watch this season.  Miles tearing up a bit (awww).  Adam says he’s “a superstar”.

Lindsay is full on weeping with pride.  Goddamn, my house is dusty.

10, 10, 10 – I would have called foul on anything less.

Sky & JT last…and it looks like a surfer Christmas theme.

It’s a cute routine, and energetic – but it feel like there was a lot of posing and non-dancing moments. I think Miles’ freestyle had the best content.

All three judges generally commenting on Sky being an “inspiration”.  Sorry guys – things are moving so fast and the judges are kinda being repetitive anyway.

Three 10’s – and I believe their score of a perfect 60 leaves them at the top of the leaderboard as the audience votes for the winner…

And the winner is…

…SKY & JT!!!

Alan is full-on bawling. Alexis who? This is what real emotion looks like from this man.

PureDWTS Carrie Ann Inaba to Permanently Replace Julie Chen on The Talk?

Per Variety, it looks like Carrie Ann may be getting a new gig:

Carrie Ann Inaba is set to take over Julie Chen’s chair on “The Talk.”

Sources tell Variety that Inaba has closed a deal to join the CBS daytime chat show, and will come aboard in January. A CBS representative declined to comment for this story.

Inaba has been one of several guest hosts filling in since Chen’s departure from the daytime talker in September, which came on the heels of Chen’s husband–CBS chairman and CEO Leslie Moonves–being ousted from the company over multiple allegations of sexual harassment and assault.

Inaba joins a panel that consists of Eve, Sara Gilbert, Sharon Osbourne and Sheryl Underwood. Previous co-hosts include Marissa Jaret Winokur, Holly Robinson Peete, Leah Remini, and Aisha Tyler.

So what does this mean for DWTS? My guess is that she may see the writing on the wall and realize that DWTS is a sinking ship, and that she needs to strike while the iron is hot and slide into a more permanent (and probably lucrative) gig. I don’t see CBS sharing her, either, especially if she’s permanently contracted for The Talk. So who knows – maybe we’ll see a shakeup on the judging panel. I think they’ve got time to figure it out, given that we likely won’t see a spring season until at least April, if at all. Can’t say that I’d particularly miss her on the judging panel – she seems to be the judge most likely to effusively gush over just-ok routines and nitpick fantastic ones in order to fit an agenda.

PureDWTS DWTS Juniors, Season 1, Week 9 – Who’s Dancing What for the Finale?

Hard to believe we’re already down to the finale! This week is gonna probably gonna feel like a mad dash – they’ve gotta fit (8) dances into one hour, with the inevitable filler you get from a finale (returning couples, bumpers, pro dances, etc.).

I think the only “favorite dance” pick that DOESN’T surprise me is Ariana & Artyon; the rest I just kinda go “Really? That dance? Ooooookay then.” I don’t know about you guys, but I cannot WAIT to see Brandon join Ariana & Artyon in that number 😛 As for the freestyles, I kinda like that they gave everyone the same theme (Christmas, which all kids can relate to), as it levels the playing field. Most kids probably wouldn’t be able to handle something really edgy or “out there” for a freestyle, or some overwrought contemporary-tinged freestyle.  Keep it simple, keep it familiar.  I like 🙂
